Terms of Use

These Terms of Use govern your access to and use of EatThinkGo™, including the EatThinkGo website, application, assessments, personalized nutrition features, meal-planning tools, symptom-tracking tools, educational content, subscription services, and related features. EatThinkGo is owned and operated by CBI Coaching LLC.

By creating an account, purchasing a subscription, or otherwise accessing or using EatThinkGo, you agree to these Terms of Use and acknowledge the Privacy Policy. If you do not agree to these Terms, do not use EatThinkGo.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or purchase an EatThinkGo subscription. By using EatThinkGo, you represent that the information you provide is accurate, you are legally permitted to use the service, you will comply with these Terms and applicable law, and you are not prohibited from using the service under applicable law. EatThinkGo is intended primarily for individual consumer wellness use.

2. Consumer Wellness and Educational Service

EatThinkGo is a consumer wellness, functional nutrition education, meal-planning, and lifestyle-support platform. EatThinkGo may provide general functional nutrition education, personalized educational insights, meal suggestions, recipes, grocery lists, symptom and wellness tracking, cognitive nutrition information, food and lifestyle recommendations, and tools for organizing nutrition and wellness habits. EatThinkGo does not provide medical care.

3. Medical and Healthcare Disclaimer

EatThinkGo does not provide medical advice, diagnosis, prognosis, treatment, therapy, prescribing, or emergency services. Information provided through EatThinkGo is for general education, nutrition planning, and wellness support only. It is not a substitute for care from a physician, registered dietitian, licensed mental health professional, pharmacist, or other qualified healthcare professional.

Use of EatThinkGo does not establish a physician-patient, clinician-patient, dietitian-patient, therapist-client, or other licensed healthcare relationship. Do not use EatThinkGo to diagnose, treat, cure, or prevent a disease or medical condition. Do not delay, disregard, or replace professional medical advice because of information received through EatThinkGo.

Contact a qualified healthcare professional before making significant dietary, supplement, medication, exercise, or health-related changes, particularly if you have a diagnosed medical condition, are pregnant or breastfeeding, take prescription or over-the-counter medications, have food allergies or intolerances, have a history of an eating disorder, have a metabolic/neurological/cardiovascular/kidney/liver/endocrine/digestive/psychiatric condition, or are receiving medical treatment. Never stop, start, or change medication based on EatThinkGo content.

EatThinkGo is not an emergency service. If you believe you are experiencing a medical or mental health emergency, call 911 or contact an appropriate local emergency service immediately.

4. Personalized Information Is Not Medical Care

EatThinkGo may generate personalized content based on information you provide. Personalization does not mean that the content has been reviewed or approved by a physician or other licensed healthcare professional. Generated recommendations depend on the accuracy and completeness of user-provided information, the limitations of the platform, available nutritional information, general wellness principles, and software rules, algorithms, or automated systems. Personalized content may not account for every medical condition, medication, allergy, nutrient interaction, laboratory result, contraindication, or individual need. You are responsible for evaluating whether a recommendation is appropriate for you and obtaining professional guidance when needed.

5. Food Allergies, Sensitivities, and Food Safety

You are responsible for reviewing all ingredients, recipes, meal suggestions, substitutions, and product labels before consuming or preparing food. EatThinkGo cannot guarantee that any meal, recipe, ingredient, product, restaurant item, or food-processing environment is free from allergens or cross-contact. Food ingredients and product formulations may change without notice. If you have a known or suspected food allergy, intolerance, sensitivity, or medically prescribed diet, consult a qualified healthcare professional and independently verify all ingredients. You are responsible for safe food purchasing, ingredient verification, proper food storage, appropriate preparation, cooking temperatures, food sanitation, and avoiding allergens and contraindicated ingredients.

6. Account Registration and Security

Some features require an account. You agree to provide accurate and current information, maintain the confidentiality of your password, use reasonable security practices, notify us promptly of suspected unauthorized access, and accept responsibility for activity occurring through your account. You may not create an account for another person without authorization, share login credentials with unauthorized users, attempt to gain unauthorized access to another account, circumvent subscription limits or security controls, or use automated methods to access the platform without written permission. We may suspend access when we reasonably believe an account has been compromised or used in violation of these Terms.

7. Free and Paid Services

EatThinkGo may offer free and paid service levels. Features, usage limits, pricing, and availability may differ by plan. Current plan details will be displayed on the pricing, subscription, or checkout page. Free features may be limited by number of uses, available tools, available recommendations, storage, personalization, support level, or other platform limits. Paid features may require an active subscription. We may modify plan features prospectively. Material changes affecting an active paid subscription will be communicated when required by law.

8. Trials, Billing, and Automatic Renewal

EatThinkGo may offer a free or discounted trial. The trial length, price after the trial, billing interval, and renewal terms will be displayed before enrollment. Unless otherwise stated at checkout, paid subscriptions automatically renew at the end of each billing period until canceled.

By beginning a paid subscription, you authorize the applicable payment processor to charge the payment method on file for subscription fees, applicable taxes, and other charges clearly disclosed and authorized at checkout. You are responsible for maintaining a valid payment method. If payment fails, access to paid features may be limited, suspended, or terminated.

9. Subscription Cancellation

You may cancel a subscription through the available account or subscription-management settings. When cancellation is completed, future automatic renewal charges will stop, access to paid features may continue through the end of the current paid billing period, and cancellation does not automatically provide a refund for a completed billing period. If self-service cancellation is temporarily unavailable, contact support@eatthinkgo.com before the next renewal date. Deleting the application, leaving the website, or discontinuing use does not necessarily cancel an active subscription.

10. Refunds

Except where required by law or expressly stated in a written refund policy, subscription payments are nonrefundable after a charge has been completed. We may consider refund requests involving duplicate charges, confirmed technical billing errors, or other exceptional circumstances at our discretion. Nothing in this section limits nonwaivable consumer rights provided by applicable law.

11. User Information and Responsibility

You retain ownership of the information you submit to EatThinkGo. You grant CBI Coaching LLC a limited license to host, store, process, reproduce, and use submitted information as reasonably necessary to operate the platform, provide requested features, generate personalized content, maintain security, provide support, and comply with legal obligations. You are responsible for the accuracy of information you submit. Do not submit information that you do not have permission to provide, that violates another person’s privacy or intellectual property rights, that is unlawful, fraudulent, threatening, abusive, or harmful, that contains malicious software, or that attempts to compromise platform security. Our handling of personal information is further described in the Privacy Policy.

12. Intellectual Property

EatThinkGo and its content, design, branding, software, assessment structure, educational materials, text, graphics, icons, logos, meal-planning systems, recommendations, and other proprietary materials are owned by or licensed to CBI Coaching LLC. EatThinkGo™, CBI Coaching, associated logos, taglines, and brand elements may be protected by trademark, copyright, and other intellectual property laws.

Subject to these Terms, we grant you a limited, personal, revocable, nonexclusive, nontransferable license to use EatThinkGo for lawful personal purposes. You may not, without written permission, copy or reproduce substantial portions of the platform, sell or commercially distribute platform content, republish paid content, share subscription access, scrape or systematically extract content, reverse engineer the platform, remove copyright or trademark notices, create derivative commercial products from proprietary content, use EatThinkGo content to train an artificial intelligence or machine-learning model, or misrepresent EatThinkGo content as your own professional or clinical work. You may download or print materials only when the platform expressly permits it and only for your personal, noncommercial use.

13. Acceptable Use

You agree not to use EatThinkGo for unlawful purposes; interfere with platform operation; attempt to bypass access or usage restrictions; introduce malware or harmful code; probe, scan, or test system vulnerabilities without written permission; use another person’s account; impersonate another person or organization; submit fraudulent information; harass users or staff; use automated bots or scraping systems without authorization; resell or commercially exploit the service; use the platform to provide unlicensed medical care; or use generated materials to make false, deceptive, or unsupported health claims. We may investigate suspected violations and restrict or terminate access when reasonably necessary.

14. Third-Party Services

EatThinkGo relies on third-party providers for functions such as hosting, database services, authentication, payment processing, email delivery, analytics, and technical infrastructure. Third-party services may be governed by separate terms and privacy policies. We are not responsible for third-party products, websites, outages, security practices, or content beyond the extent required by applicable law.

15. Platform Availability and Changes

We work to keep EatThinkGo available and functional, but uninterrupted access is not guaranteed. The platform may be temporarily unavailable because of maintenance, software updates, security events, internet or hosting interruptions, third-party service failures, or events outside our reasonable control. We may add, remove, modify, suspend, or discontinue features. When a material change affects a paid service, we will provide notice when reasonably practical or legally required.

16. No Guaranteed Results

Nutrition, energy, concentration, cognitive wellness, and lifestyle outcomes vary among individuals. EatThinkGo does not guarantee improved health, increased energy, improved concentration, elimination of brain fog, weight change, symptom improvement, prevention or treatment of disease, or a particular personal, professional, or financial result. Testimonials, examples, educational materials, or user experiences do not guarantee that another user will obtain the same results.

17. Disclaimer of Warranties

To the fullest extent permitted by law, EatThinkGo is provided on an “as is” and “as available” basis. CBI Coaching LLC disclaims warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, completeness, availability, security, compatibility, and uninterrupted operation. We do not warrant that all content will be error-free, complete, current, or suitable for every individual. Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted by law.

18. Limitation of Liability

To the fullest extent permitted by law, CBI Coaching LLC and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to EatThinkGo. This includes damages associated with loss of data, loss of profits, loss of business opportunities, service interruptions, reliance on platform content, dietary decisions, food preparation, allergic reactions, third-party services, unauthorized account access, and personal or health outcomes.

To the fullest extent permitted by law, the total aggregate liability of CBI Coaching LLC arising from the service will not exceed the greater of the amount you paid to EatThinkGo during the six months immediately preceding the event giving rise to the claim, or one hundred United States dollars. These limitations do not apply where prohibited by law.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless CBI Coaching LLC and its owners, employees, contractors, affiliates, and service providers from claims, losses, liabilities, and expenses arising from your unlawful use of EatThinkGo, your violation of these Terms, information you submit, your infringement of another person’s rights, or your misuse or unauthorized distribution of platform content. This section does not require indemnification for conduct caused solely by CBI Coaching LLC where such a requirement would be prohibited by law.

20. Suspension and Termination

You may stop using EatThinkGo at any time. We may suspend or terminate access when we reasonably believe these Terms have been violated, an account presents a security risk, payment remains unpaid, the platform is being misused, termination is required by law, or continuing service would expose users or CBI Coaching LLC to harm. Upon termination, your right to use the platform ends. Provisions concerning intellectual property, disclaimers, liability, disputes, and other provisions that logically survive termination will remain effective.

21. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. To the extent a dispute is not resolved informally and is not subject to a nonwaivable legal forum, the parties consent to the jurisdiction of the appropriate state or federal courts serving Greenville County, South Carolina. Nothing in this section eliminates consumer rights that cannot legally be waived.

22. Informal Dispute Resolution

Before filing a legal claim, you agree to contact support@eatthinkgo.com and provide a reasonable description of the dispute and the requested resolution. The parties will attempt in good faith to resolve the dispute informally for at least 30 days. This provision does not prevent either party from seeking urgent injunctive relief or exercising a nonwaivable legal right.

23. Changes to These Terms

We may update these Terms to reflect changes in the platform, business practices, or applicable law. The “Last Updated” date will identify the latest revision. When changes are material, we may provide additional notice through the platform, by email, or through another appropriate method. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.

24. Severability

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable when legally permitted.

25. Entire Agreement

These Terms, the Privacy Policy, and any additional terms clearly presented for a particular feature or subscription constitute the agreement between you and CBI Coaching LLC concerning EatThinkGo.
